Admin terminates teacher, lecture at GMC Sgr for unauthorized absenteeism

The administration in Kashmir has ordered the termination of a teacher and a Government Medical College (GMC) Lecturer (Dr.) for remaining un-authorized absent from duties.

Two separate orders in this regard have been issued by the Directorate of School Education Department, Kashmir and Health and Medical Education (H&ME) Department.

As per the order issued by the DSEK, “Roona Laila, Head Teacher, Upper Primary School PS Shalibathoo, Kupwara remained un-authorizedly absent from her legitimate duties w.e.f. 01-11-2009”.

The said teacher incumbent was provided opportunities by the DDO concerned to resume her duties which she failed to avail. The teacher was sent notice. The teacher responded to the said notice but upon its examination, it was found unsatisfactory and unsubstantial.

Whereas, the issue was placed before the Designated Committee in its meeting held on 11-12-2021 and after examining the case the committee took the following decision: “Process for termination under Article-113 J&K CSR of 1956” Now, therefore, pursuant to the decision of the committee, Roona Laila, Head Teacher, UPS Shalibathoo, Kupwara is hereby removed from the government service in terms of Article 113 of J&K Civil Services Rules (Volume I) of 1956 and rule 30(vii) of J&KCCA rules 1956.

Meanwhile, in another order issued by the Vivek BharadwaJ Additional Chief Secretary, H&ME, Dr. Henaan Jeelni as Lecturer in the discipline of Obstetrics & Gynecology, Government Medical College, Srinagar, are terminated with immediate effect.

As per the order issued, on the recommendation of the J&K, Public Service Commission, among others, Dr. Henaan Jeelani was appointed as Lecturer in the Department of Obstetrics & Gynecology in Government Medical College Srinagar, on 29th June 2018, as an in-service candidate and subsequently joined her duties on 10th July 2018.

Dr. Henaan Jeelani after joining her duties in Government Medical College, Srinagar submitted an application for grant of two years leave and without waiting for its formal sanction from the competent authority, she proceeded on unauthorized leave w.e.f 29.08.2019.

The Principal, GMC Srinagar vide communication on 04.05.2021 stated that a final show cause notice was served on the absconding doctor with the directions to resume her duties within a period of one week, failing which necessary action as warranted under rules shall be initiated against her, it added.

In response, Dr. Henaan Jeelanj, among other things has stated that in view of the unavoidable and emergency nature of the circumstances, she proceeded on leave awaiting its formal sanction and has requested that her leave application may be reconsidered and two years leave without pay (leave whatever due) may be sanctioned in her favour as it will not be possible her to resume her duties within the time frame due to travel restrictions in view of the severity of COVID 19 pandemic, the order reads.

From a perusal of the reply submitted by Dr. Henaan Jeelani, it transpires that she has left the station/ country, without seeking proper permission from the Government. The case was been examined in the Health & Medical Education Department in light of Article 128 of the Jammu & Kashmir, Civil Service Regulations and it has been found that Dr. Henaan Jeelani had remained un-authorizedly absent from her duties and, therefore, she has lost her service in view of the import of Article 128 of the Jammu & Kashmir, Civil Service Regulation, it added.
“Now, therefore, the services of Dr. Henaan Jeelni as Lecturer in the discipline of Obstetrics & Gynecology, Government Medical College, Srinagar, are terminated with immediate effect, the order reads”, order reads.
