H&ME dept. terminates MO for remaining un-authorized absent
The health department in Kashmir has terminated a Medical Officer for remaining un-authorized absent from duties.
The termination of the Medical Officer comes two weeks after the health department suspended a Doctor who was appointed as a Lecturer at Government Medical College Srinagar for remaining un-authorized absent from duties.
As per the order issued by the Vivek Bharadwaj Additional Chief Secretary, Health & Medical Education Department, Jammu and Kashmir, Dr. Aadil Fayaz Parray was appointed as Medical Officer in the Health Services Department and was posted at District Hospital Shopian dated 31st December 2020.
Whereas, the aforesaid doctor while posted at District Hospital Shopian resorted to tun-authorized absence front his duties w.e.f. 04.09.2021 and accordingly a notice was issued by the Director, Health Services, Kashmir to the absentee under endorsement dated 16.11.2021.
The doctor as per the order was provided an opportunity to report to his duties at District Hospital Shopian within seven days from the date of issuance of a notice, failing which it shall be presumed that he is not interested to serve the department anymore and case shall be submitted to Administrative Department for termination of his probation, resultantly discharging him from Government services, as he had resorted to unauthorized absence during the probation period.
“The said doctor failed to report back to his duties, as reported by Medical Superintendent District Hospital Shopian vide his letter dated 03.12.2021. The Director, Health Services, Kashmir has forwarded the case of the said doctor to the Administrative Department for further necessary action”, the order reads.
The matter has been examined/ considered in the Administrative Department with reference to the basic purpose of appointment of these Medical Officers and the rules governing the subject.
As such, it has been found that Dr. Aadil Fayaz Parray, Medical Officer is still on probation, on account of which he is liable to be discharged from service, by terminating his probation in terms of Rule 21(1) & Rule 33 (2) & (3) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956 and Rule 4(1)(b) of the J&K Probationer (Condition of Service, Pay and Allowances) and Fixation of Tenure Rules, 2020 notified vide S.O. 192 dated 17.06.2020, the order reads.
“Now, therefore, in terms of Rule 21 (1) and Rule 33 (2) & (3) of the Civil Services (Classification, Control and Appeal) Rules, 1956 and Rule 4(1)(b) and of the J&K Probationer (Condition of Service, Pay and Allowances) and Fixation of Tenure Rules, notified vide S.O. 192 dated 17.06.2020, the probation of Aadil Fayaz Parray, Medical is hereby terminated and he is discharged froth the J&K Health & Family Welfare (Gazetted) Service for remaining unauthorized absent from duties w.e.f. 04.09.2021”, the order reads.
