CAT rejects claim of Dr. Rakesh for post of Medical Superintendent GMCH
The Central Administrative Tribunal (CAT), Jammu has rejected the claim of Dr. Rakesh Sharma for posting as medical Superintendent of Government Medical College Hospital, Jammu and found it devoid of merit. Implementing CAT order, the Health and Medical Education has clarified that Dr. Sharma will become eligible for the post of Medical superintendent, GMC, Jammu only on September 26, 2023-after completing five years Service as Deputy Medical Superintendent as per rules.
Dr. Rakesh Sharma Deputy Medical Superintendent, SMGS Hospital Jammu has contested the appointment of Dr. Narinder Singh Bhutyal as incharge medical Superintendent, Government Medical College Hospital. Aggrieved by the Government Order, Dr. Rakesh Sharma filed an application before Central Administrative Tribunal, Jammu who have passed an order dated 14.11.2022 in 0.A/1550/2022 titled Dr. Rakesh Sharma Vs Health and Medical Education Department.
The health and medical education department while examining/considering the representation of the applicant dated 20.07.2022, in pursuance of the aforesaid order dated 14.11.2022 passed by the CAT, it transpires that Dr. Rakesh Sharma has been appointed/posted as Deputy Medical Superintendent, Government Medical College, Jammu in pursuance of Government Order No. 539-HME of 2018 dated 27.09.2018 and thereafter posted in SMGS Hospital, Jammu in pursuance of Government Order No. 606-HME of 2018 dated 25.10.2018. Now the concerned doctor is representing for his placement as 1/c Medical Superintendent at Government Medical College, Jammu against the available vacancy.
In terms rule position Dr. Government Medical College, Jammu being appointee of 09/2018 becomes eligible for considering his placement against the post of Medical superintendent, GMC, Jammu on 26.09.2023 i.e after completing five years Service as Deputy Medical Superintendent.
The health and medical education department has implemented the of order dated 14.11.2022 passed by the Central Administrative Tribunal, Jammu in 0.A/1550/2022 titled Dr. Rakesh Sharma Vs Health and Medical Education Department. The order has said therefore in compliance of the order dated 14.11.2022 passed by the Central Administrative Tribunal, Jammu in the case 0.A. No.1550/2022 titled Dr Rakesh Sharma Vs Health and Medical Education Department, the representation of the applicant has been considered and found devoid of merit, hence rejected. However, he shall be considered for his placement/promotion against the post of Medical Superintendent as and when he attains the requisite eligibility as envisaged under Jammu and Kashmir Medical Education (Gazetted) Service Recruitment Rules, 1979.
Moreover in its order H&ME has said that Dr. Narinder Singh Bhutyal was initially appointed as Medical Officer on 12.08.1997 and is a Post Graduate with administrative experience as well being among senior most Medical Officers; in the interest of administration and patient care and due to administrative exigencies on account of retirement on superannuation of various posts, the Health and Medical Education Department vide Government Order No. 771-JK{HME) of 2022 dated 31.10.2022, among others, transferred Dr. Narinder Singh Bhutyal incharge Deputy Medical Superintendent, Government Hospital, Gandhi Nagar, Jammu and posted him in the Government Medical College, Jammu. It was ordered that the Medical Officer shall also look after the charge of Medical Superintendent, Government Medical College, Jammu.
