Admin notifies forms to alienate land to non-agriculturists in J&K

Two months after approving regulations, the administration has notified prescribed forms of the grant of permission of agriculturists to alienate the land to non-agriculturists.

In November, the government had notified the provision under the Jammu and Kashmir Land Revenue Act, the J&K has authorized District Collectors to grant permission for carrying out agriculture and horticulture activities.

Whereas, in the notification issued by the Revenue Department, quantum up to 20 Kanal shall be a purpose for agriculture and allied activities and quantum up to 80 Kanal shall be for the purpose of horticulture/orchards.
Whereas, last month, the Jammu and Kashmir administrative council approved the regulations for conversion of agricultural land for non-agricultural purposes. As per the decision taken by the administrative council, the permission is to be granted within 30 days of the filing of the application with a provision of deemed approval if no decision is taken.

The powers have been delegated to the District Collector to grant permission for land up to 12 ½ standard acres against a fee of 5 per cent of the market value of the land notified under the Stamps Act.

In this regard, an order has been issued by Vijay Kumar Bidhuri, Commissioner, Secretary to the Government.
“Forms annexed are hereby prescribed for the purpose of grant of permission by District Collector to an agriculturist to alienate the land to a non-agriculturist in accordance with the procedure notified vide SO 373 dated 01.11.2021 issued under endorsement No. Rev-S/03/2021 (21030) dated 01.11.2021”, the order reads.

As per the order, the applicants while referring form to the District Collector have to mention Khata no, Khewat no, Khasra numbers, quantum land and classification.

Further, the affidavits of the parties are to be attached with a form declaring that the transaction is not in violation of statutory provision and conditions for the transaction and the person is qualified to take up such activity and transaction should not make transferor landless.

Whereas, the form by the District Collector will notify the District, Tehsil, Village, Khasra no, Quantum Land (Kanal and Marla), Classification of land, name and particulars of transfer and the purpose of transfer and remarks.
