Three-wheelers, e-rickshaw don’t need to affix VLTD: Transport Dept
The Jammu and Kashmir government on Tuesday said that three-wheeler, passenger autos and two-vehicles do not need to affix Vehicle Location Tracking Device (VLTD).
The department further said that all public service vehicles, as defined under clause 35 of section 2 of the Act, shall be equipped with or fitted with vehicle location tracking devices and one or more emergency buttons.
An official communiqué in this regard has been sent by the Office of the Transport Commissioner, Jammu and Kashmir to the Regional Transport Officer, Kashmir.
This has reference to the subject cited above and your kind attention is invited to Section 2(35) of the Motor Vehicle Act, 1988 and is reproduced below: “public service vehicle” means any motor vehicle used or adapted to be used for the carriage of passengers for hire or reward and includes a maxi cab, a motor cab, contract carriage, and Stage carriage, it reads.
Further, GSR 1095(E) of 28.11.2016 issued by the Ministry of Road Transport & Highways read as under: “Provision of vehicle location tracking device and emergency button, it reads.
All public service vehicles, as defined under clause 35 of section 2 of the Act, shall be equipped with or fitted with a vehicle location tracking device and one or more emergency buttons. Provided that this rule shall not apply to the following category of vehicles, namely two-wheelers, e-rickshaw, three-wheeler and any transport vehicle for which no permit is required under the act In view of the above.
“I am directed to conveyed that vehicles, as exempted, as per the above guidelines of the MoRTH, may not be compelled to go for installation of VLTD, so as to ensure making the process of fitness of vehicles very smooth”, reads the official communiqué issued by Joint Transport Commissioner.
“In case, any of the vehicles in an aforesaid exempted category is not passed by the BOI for want of installation of VLTD, a well reasoned / speaking order should be passed. A report on vehicles, who applied for the fitness and subsequently rejected on grounds for want of non-installation of VLTD be submitted to this office after every Inspection by the Board”, it reads.
