SED warns officials of action for violation of transfer rules

The education department has issued a stern warning to officials stating that lecturers appointed under SRO-192 of 2020 shall not be transferred unless and until they work for five years on the post against which they have been initially appointed.

Sources said that Principals and DDOs of various schools across the Jammu and Kashmir have transferred several lectures, which the education department has called “tantamount to mislead the government”.

As per the policy/ rules under SRO-192 of 2020, read with SRO 202 of 2015, such appointees are not transferable before 05 years of service. Taking note of the issue, a circular has been issued by Mohammad Iqbal Mir, Under Secretary to the Government, School Education Department.

It is impressed upon all the concerned through the medium of this circular that the School Education Department has adopted an online facility to facilitate the transfer of lecturers for their convenient/suitable postings, the circular reads.

The School Education Department has received online transfer requests from the Lecturers, which are further processed subject to their choices, availability of clear and deemed vacancy, it added.

“To make this system more transparent, successful, and effective it was imperative and obligatory on the part of the interested applicants to furnish the factual/correct information, and the same was reiterated in the Notification No. 01 of 2022 under heading 7(d) which reads as under”, it reads.

“Submission of wrong, false or fabricated information shall lead to rejection of candidature and action under provisions of CSR will be initiated”.

It has come to the notice that some lecturers, appointed under SRO-202 of 2015, have applied for their transfers and subsequently have got their transfer affected as well under ATD-2022., it added.

“As per the policy/ rules under SRO-192 of 2020, read with SRO 202 of 2015, such appointees are not transferable before 05 years of service. The operative part reads, “The appointees under these rules shall have to necessarily work for a period of five years on the post against which he has been initially appointed and such appointees shall not be eligible for transfer for whatsoever reason during the period of five years”, the circular reads.

“As it was self-explanatory, such appointees should not have applied in the first instance for transfers/ postings; the action is tantamount to misleading the Government”, it added.

“Now, therefore, it is impressed upon all the Principal(s)/ DDCs of the school concerned from where and to which such transfer orders are issued/affected, not to relieve such transfers and not to allow them to join at the transferred place of posting”, the circular reads.

“It shall be the responsibility of the Principal(s)/ DDOs of the school concerned to report all such cases to the department immediately without any failure and delay, so that the necessary punitive action against the violators of the rules/ guidelines be initiated as per the relevant provisions of the Civil Service Regulations, 1956”, it added.
